At Spire Law, one of our core practice areas is providing front end and back end legal services to property developers and the building and construction industry.
From domestic building contracts and small scale residential projects to large commercial and civil developments, our approach is simple: discover all the facts and the desired outcome, design a solution to achieve the outcome, and deliver the solution within the timeframe.
For developers, our front end services include all stages of a project’s lifecycle: structuring and documenting the project from its conception, including acquiring, amalgamating or subdividing the site, preparing and negotiating construction contracts, access and oversail deeds, preparing sales contracts and commercial and residential leases and carrying the project through to completion and the settlement of sales or registration of leases. For principal contractors, we prepare and negotiate head contracts, subcontracts and purchase orders.
When things don’t go to plan, our back end services include identifying and mitigating risk, enforcing contractual rights, adjudications and appeals under the Building Industry Fairness (Security of Payment) Act, alternative dispute resolution, QCAT and Court proceedings in relation to all manner of disputes as well as QBCC licencing issues, directions to rectify defective and/or incomplete works, internal and judicial reviews and appeals, matters under the Planning and Environment Act and other regulatory investigations and prosecutions involving Work Health and Safety and Electrical Safety.
